Trump Requests Supreme Court Clearance for State Guard Forces in Illinois

On the end of the week, the administration submitted an urgent appeal to the federal top court, asking for clearance to station national guard troops to the state of Illinois.

This action is part of a larger campaign to increase the homefront role of the armed forces in a number of cities run by Democrats.

Court Fight Over Military Presence

In an urgent petition, the justice department pressed the bench to set aside a previous judicial decision that had halted the deployment of hundreds of state guard troops to the Chicago region.

The presiding judge had expressed skepticism about the White House's reasoning for deploying forces, challenging its rationale in given local conditions.

A federal appeals court supported the previous order on the previous day, maintaining the deployment on pause while the court case moves forward.

Government's Claims

The top government lawyer, speaking on behalf of the administration, wrote in the new filing that government officers have frequently been “intimidated and targeted” in downtown Chicago and the suburb of Broadview community.

This location is home to an ICE detention facility.

The former president has earlier deployed military reserve units to the Windy City and Portland, Oregon, after prior activations to Los Angeles, California, the city of Memphis, and the nation's capital.

The president has stated that military intervention is required to reduce protests and bolster border control.

Ideological Opposition

Democratic officials have pushed back sharply the decision, arguing that the president’s claims are greatly exaggerated and politically motivated.

They accuse the administration of abusing his power to retaliate against critics.

Legal Basis

At the heart of the conflict is the administration's application of a US code allowing the commander-in-chief to federalize the national guard only in instances of uprising or when “powerless with the standard military to enforce the statutes of the United States”.

The administration maintains that the troops are essential to safeguard government buildings and personnel from activists.

In recent weeks, the government nationalized several hundred members of the Illinois national guard and ordered additional Texas national guard forces into the state.

As city officials denounced the move, the president increased his statements, demanding the apprehension of the mayor of Chicago and the governor of Illinois, both Democrats, alleging them of not managing to secure ICE personnel.

Illinois and municipal government filed a combined lawsuit the government to block the deployment.

On the ninth of October, Judge April Perry, appointed by Joe Biden, issued a temporary injunction blocking the directive.
